Appellate Litigation

A well-crafted appeal can be the key to overturning a disappointing litigation outcome — or preserving a successful one. KLLF attorneys have experience litigating before state and federal appeals courts as well as the United States Supreme Court. Our appellate track record includes:

  • Reinstating the discrimination claims of a New York City police officer who alleged that he was mistreated by NYPD leadership based on anti-Arab and anti-Muslim stereotypes. Abdelal v. Kelly, 857 F. App'x 30 (2d Cir. 2021).

  • Establishing that forensic scientists and technicians had a clear legal obligation to disclose exculpatory evidence and can be sued for damages for violating that obligation. Horn v. Stephenson, 11 F.4th 163 (2d Cir. 2021).

  • Filing an amicus curiae brief in the Sixth Circuit on behalf of leading national sexual violence and victim advocacy organizations in support of a successful effort to reinstate the claims of victims of sexual abuse at Ohio State University.

  • Supporting efforts to adopt a more liberal approach to claims brought by victims of evidence fabrication by police, on behalf of leading civil rights and criminal defense organizations as amici curiae, ultimately contributing to a favorable ruling by the Second Circuit.

  • Representing exonerees arguing to the Fourth Circuit that West Virginia counties can be held liable for violations of their civil rights caused by prosecutors’ deficient training and supervision.
