Are You a Member of the DOCCS Shock Class?

On July 1, 2025, notice was sent to potential class members in Caballero v. New York State Department of Corrections and Community Supervision, No. 9:20 Civ. 147 (N.D.N.Y). This lawsuit claims that DOCCS violated Class Members’ rights by excluding them from the Shock Incarceration Program because of their mental health. The Court has found that DOCCS violated Class Members’ rights under federal laws against disability discrimination. The Court’s decision is not final or binding yet.

 You are a member of the class if you:

  1. were incarcerated in the New York State prison system by DOCCS;

  2. were eligible by law to enroll in Shock;

  3. were excluded from Shock on the basis that your mental health status was “OMH Level 3” at any time from 12/2/2017 to 11/3/2021;

  4. were not ordered to be enrolled in Shock by your sentencing court; and

  5. were not offered another six-month pathway to early release.
